Before You Begin

  • TIME: Expect this process to take approximately 6 months to complete.
  • FEES: There are a number of fees associated with the expungement process.
    • Apply for Certificate(s): The application costs $65.
    • Purchase Certificate(s): Each certificate costs $65.
      • You need a certificate for each case you want to expunge.
    • File Petition(s) with the court: Each petition you file with the court costs $150 per certificate.
      • Low income individuals can ask the court to waive the fees.
    • Purchase Certified Orders: Cost is approximately $25 per case.

Example: An individual who has 2 criminal cases eligible for expungement can expect to pay approximately $550 in fees ($65 for application + $130 for two certificates + $300 for filing two petitions + $50 for orders.) If this individual asks and is granted a fee waiver on the court fees, the cost would be approximately $195.

  • NOTE:
    • This guide is intended as a community resource that provides assistance with the petition-based expungement process. You are free to use other resources instead if you choose. 
    • This guide assists individuals in expunging their eligible Utah Adult Criminal Records. It does NOT help expunging juvenile, federal, or criminal records from another state.
    • If you are NOT a U.S. Citizen, you should seek legal advice from an Immigration Attorney about whether to expunge your criminal records.  The FBI could have records of a criminal case, even if a state court expunged its records.
    • Expungement does not guarantee you can have your gun rights back, although it may increase your chances. It does NOT entitle you to be able to use a firearm, if you have lost that privilege.
