For Participating Jurisdictions (Prosecutor and Court both present)

Salt Lake County Justice Court, Salt Lake City Justice Court, Third District Court- Salt Lake City, Third District Court- West Jordan

  1. Fill out the Motion, Proposed Order, and Stipulation on behalf of the client, pro se. Be sure to put the client’s information and not your own in the top left corner of the first page on the Motion and Proposed Order (leave stipulation top left corner blank for Prosecutor to fill out). Discuss the client’s argument with the client on the telephone.
    • Download the documents from the website before you fill them out. If you fill them out on the website and then download them, all of the information will have to be re-entered.
    • On the Motion to Reduce Conviction, do not check the box that the prosecuting attorney agrees with this motion unless you actually have a signed stipulation and until you are actually filing the motion with the court.
    • Leave the body of the documents below the captions on the Stipulation and the Order blank. Although you may be used to providing proposed Orders, it is faster in this scenario for the Court to fill out their Findings of Fact and Conclusions of Law if you are not proposing them.
    • Make sure you request a one-step reduction as well as a two-step reduction.
  2. Sign the client’s name on the signature line in the following manner:
    /s/ Jane Doe
    Signed with permission of Ms. Doe by Attorney Name # Bar Number
  1. Email the Motion and Stipulation to MWAlvarez@slco.org, who will then forward the documents to the correct prosecutor. In the subject line, include the prosecuting agency the email should be sent to.
  1. Wait to see if the Prosecutor emails you a signed stipulation.

If the Prosecutor stipulates, email the Motion, Order, and Signed Stipulation to the Court Clerk with the subject line “402 Reduction: Stipulated to by Prosecutor”

If the Prosecutor is unable to stipulate due to Victim notification, email the Motion and the Order to the Court CIerk for filing. Inform the client to contact JaSmith@slco.org for further instructions after 21 days have passed to prepare a Request to Submit for Decision if the court has not taken any action. Do not move on to Step 5.

If the prosecutor objects to a non-victim case, email the Motion and Order to the Court Clerk with the subject line “402 Reduction: Non-Victim, No Stipulation”

  1. Enter the Webex Teams “Courtroom” Space and announce that you are appearing for a 402 Reduction Hearing on case #. DO NOT ENTER the Video Courtroom until instructed.

Follow any instructions given to you in the Courtroom Space or via email by the Clerks.
