For Non-Participating Jurisdictions (All other Utah Courts and prosecutors)

  1. Fill out the Motion, Proposed Order, and Stipulation on behalf of the client, pro se. Be sure to put the client’s information and not your own in the top left corner of the first page on the Motion and Proposed Order (leave the stipulation top left corner blank for the Prosecutor to fill out). Request a one-step as well as a two-step reduction. Discuss the client’s argument with the client on the telephone.
  • Download the documents from the website before you fill them out. If you fill them out on the website and then download them, all of the information will have to be re-entered.
  • On the Motion to Reduce Conviction, do not check the box that the prosecuting attorney agrees with this motion. On the Certificate of service, enter the Prosecutor’s name (ex. Utah County Attorney, Orem City Prosecutor). Use the following list to insert the correct Service Address

  • Leave the body of the documents below the captions on the Stipulation and the Order blank. Although you may be used to providing proposed Orders, it is faster in this scenario for the Court to fill out their Findings of Fact and Conclusions of Law if you are not proposing them.
  1. Sign the client’s name on the signature line in the following manner on the Motion to Reduce Conviction:

  1. Email the Motion and Stipulation to JaSmith@slco.org. The documents will be mailed out by the Expungement Navigator to the correct prosecutor immediately following this event. Service to prosecutor will be sent today via postal mail.
  1. On page 3 of the Motion, the Certificate of Service, select the service option MAIL and put today’s date as the service date. Sign and date in the same fashion as described in instruction 2 above.

  2. For District Courts: Email the Motion and the Order to the client with the following instructions:

During the pandemic due to COVID-19, all courts will be accepting emailed documents to be filed in existing cases. Please follow the guidelines below when emailing documents to be filed in your case. Your email must include the following:

A subject line that says "Filing in case # (include your case number)"

Your contact information in your email - including the best way to contact you (phone number, email address.)

Attached documents you want to file.

For Justice Courts: Email the motion & order to Jake Smith (JaSmith@slco.org). The documents will be mailed out to the correct courts immediately following the event.

  1. Inform the client to contact JaSmith@slco.org for further instructions after 21 days have passed to prepare a Request to Submit for Decision if the court has not taken any action.
