Conditional Use Home Occupation
Meet with a Planning and Development Services Information Specialist and describe what type of business you plan to operate from your home.
The Information Specialist will provide you with the proper application form. It is necessary for you to submit the following materials:
- A Legal description of the parcel;
- A current lined aerial plat with the the subject property outlined in a red marker;
In Addition, if people will be coming to the home as a result of the business, you will also need to submit:
- List of surrounding property owners (within 300 feet);
- Print names, addresses on labels

When you have completed the Home Occupation Conditional Use Application form and have the necessary materials, submit the application and pay application fees.
You are required to meet with a Planner
to go over your application submittal.
The planner will be able to inform you how your application will be processed. Deficient applications will not be accepted.
If people will be coming to the home as a result of the business, contact the appropriate Community Council representative. It will be necessary for you to attend a regularly scheduled Council meeting to present your proposal. After this meeting, the Council will make a recommendation to the Planning and Development Services Division.
If people will be coming to the home as a result of the business, a letter will be sent to you and your neighbors by the Planning and Development Services Division with information about your request.
Various County agencies (Fire, Building Inspection, City-County Health, etc.) will review your request and make recommendations to the Planning and Development Services Staff. It is the applicant's responsibility to follow up with the various agencies to complete their specific requirements.
In addition to the application fees,
you may be required to pay for inspections by other departments.
Contact the Planning and Development Services Division after the staff decision date or after the Planning Commission decision to review further requirements before a final use permit is issued.

Appeal Process - If your application is denied by Staff or you disagree with conditions required for the approval of the application, you have 10 (ten) days in which to appeal. It will be necessary for you to attend a Planning Commission meeting. You will be notified of this public meeting date, at which you should be prepared to present your proposal in detail and answer questions.
